Terms of Service

§ 1. General Provisions

  1. These Terms of Service govern your access to and use of the Momentum website, applications, and services. By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.
  2. The Service is owned and operated by Momentum Financial Literacy Corp., a Canadian corporation. These terms constitute a legally binding agreement between you and Momentum. Please read them carefully before using the Service.
  3. If you do not agree to these Terms, you must not access or use the Service. We reserve the right to modify these Terms at any time. Your continued use of the Service constitutes acceptance of such changes.
  4. The Service is intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Service. You affirm that you are of legal age.

§ 2. Definitions

  • Platform – The online educational platform operated by Momentum, available through its website and associated applications, offering financial literacy tools.
  • User – Any natural person with full legal capacity who creates an Account and uses the Services provided by the Platform for personal, non-commercial purposes.
  • Account – A personalized section of the Platform, created upon registration by a User, allowing access to the full scope of Services.
  • Services – All educational content, tools, features, and functionalities offered to the User through the Platform, including courses, budgeting tools, and financial tracking.
  • Regulations – This document, the Terms of Service, which defines the rights and obligations of the User and Momentum.

§ 3. Type and Scope of Services Provided

  1. Momentum provides educational services in the field of personal finance. The Services are for informational and educational purposes only and do not constitute financial, legal, or tax advice. You should consult with a professional for advice tailored to your specific situation.
  2. The scope of Services depends on the plan selected by the User. A free 'Starter' plan with limited features and a paid 'Pro' subscription with full access to all content and tools are available.
  3. We grant you a limited, non-exclusive, non-transferable, and revocable license to use our Service for your personal, non-commercial use, subject to these Terms. All rights not expressly granted are reserved by Momentum.
  4. Momentum reserves the right to modify, suspend, or discontinue the Service, or any part thereof, with or without notice at any time. We will not be liable for any such modification, suspension, or discontinuance.

§ 4. Technical Requirements

  1. To use the Platform, the User must have a device with internet access and a current version of a standard web browser (e.g., Chrome, Firefox, Safari, Edge) with cookies and JavaScript enabled.
  2. The User is solely responsible for ensuring that their device and software meet the necessary technical requirements to access and use the Platform.
  3. Momentum is not responsible for any disruptions or limitations in the functioning of the Service resulting from inadequate technical equipment of the User.

§ 5. Rights and Obligations of the User

  1. The User agrees to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate. You are responsible for safeguarding your account password.
  2. The User agrees not to use the Service for any unlawful purpose or in any way that could harm, disable, overburden, or impair the Service. Prohibited activities include data scraping and reverse engineering.
  3. All content provided on the Platform, including text, graphics, logos, and software, is the property of Momentum or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from this content.
  4. The User is solely responsible for their financial decisions. Momentum provides tools and information, but the outcomes of your financial decisions are your own responsibility. We are not a financial planner or advisor.
  5. The User may terminate their account at any time through the account settings. Termination does not entitle the User to a refund of any subscription fees already paid, except as required by law.

§ 6. Final Provisions

  1. These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.
  2. Any disputes arising from these Terms or the use of the Service shall be resolved in the competent courts located in Toronto, Ontario.
  3. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
